Richard Pack's attorney Stephen Hurst notified the courts that his client and another parishioner are no longer pursuing the case. They have up to a year to re-file.

Last month, Pack and another parishioner filed a lawsuit against Old Pathway Gospel Church, claiming Pastor James Leach removed $42,000 from the congregation's bank account and changed the locks to the church.

A handful of parishioners also wanted split from the pastor and the church's regular services, according to Linda Mock, the pastor's daughter. After failed attempts at sharing the building, a judge lifted the restraining order, allowing services to resume.
